If someone who came here on visa and was only supposed to be for 6 months stayed for more than 2 year'sand is now getting foodstamps, is that welfare fraud?

I would assume that there would only be fraud in the situation if that person lied about his or her status in order to get foodstamps.
If the foodstamp office requires some form of legal status and that person said he or she was here legally, then that would be a lie and could possibly constitute welfare fraud.
