What is store's liability? I injured my back loading several large containers because store employees failed to assist me.
Question Details:
I went to Wal-Mart to get several storage containers. When I first arrived to the dept. I looked for an employee to help me. I could not find one. So I walked around to find any employee for help. I asked 3 different one's and was told by each that they would get the right person to help. After one hr. 55min., I started loading a total of 35 containers myself. As I tried to separate the 18 gal. containers(they were stuck together) they suddenly broke loose and I tweaked my lower back. For the last 3 day's I have suffered weakness, headache, nausea and extreme pain in lower back. Now what do I do?
I am a lawyer in CT and practice in this area of the law. It sounds like the store employees neglected to wait on you and you therefore, took matters into your own hands and "did it yourself." The question is whether the store was negligent in failing to assit you and as a result you were injured. the problem is that you made the decision to assume the risk of loading the large containers on your own. the fact that your decision not to either leave the store of find a manager proximately caused your injury it is unlikely that the store will be at fault here. However, I would meet with a lawyer to discuss filing a claim as the company may give you some money to avoid a lawsuit.

Are you a lawyer?
