Question: Criminal Defense - California

Asked on 8/10/2009
I hired a Quack Electrician that illegally wired my house. Now my wife is being charged w/ stealing electricity. The acct. is in her name. plz help..
We remodeled our Bathroom about 6 months ago. I needed an electrician to put in some fixtures. I went cheap and hired someone out of the Pennysaver. He completed the work then proceeded to say he could cut my electricity bill by at least $50.00 a month with new energy efficient circuit breakers for an addit. $100.00. He showed me a breaker w/ the green star logo (energysaver) I went for it. To make a long story short. There is no such thing as energy efficient breakers. He illegally wired my meter. Now my wife of 17 yrs is in trouble. I have no way to find this guy, and paid cash. Please Help

Although I do not practice law in the State of California, here are my initial impressions.  First, since you do not state exactly how your wife is in trouble (i.e. is she being investigated?  has she been arrested?  if so, what has she been charged with) it is difficult to give you very specific advice.  What I can tell you, however, is that lack of intent is probably a defense to whatever crime she is being investigated for or charged with.  Therefore, I suggest that you and your wife consult with and/or retain a criminal defense attorney to discuss this matter in greater detail in the interest of evaluating this defense, as well as any others, that may exist.  The sooner your wife gets an attorney, more she will minimize the trouble she is in.  Good luck.

AttorneyPages has verified that this person is an attorney.

Has your wife been arrested?  Are there any court dates pending?  If so, which court is the case in?  Even though you paid cash, did you at least get some type of receipt, and/or a card from this person?
