What can I do if I paid for services that a contractor never rendered?

I hired a contractor; paid $8,000. Work was never started. Contractor was to waterproof the foundation around the house by breaking the concrete and dig all the way down to the footing and waterproof the walls, back filled and re-cement. Services were never done and I was not refunded for my money.
