I have proof my LLC member is embezzling from the company what too do?
Question Details: She has personal account that she uses to make the home equity loan payment out of. Now she writes more to the account then she pays. Once she only paid 48$, and wrote a check for 1400$. I got the account history!!She has been transfering a 1000$ to her home account, last time right before her vacation!! It was my 40 yrs. expierence and joy in the restaurant this was my dream! Now I can't trust her and don't know how best to handle this.
I think you know what you should do. If you believe you have evidence that she is stealing--and embezzelment is theft, as surely as is armed robbery--you should report her to the police and also retain a good personal attorney and accountant, who together can advise you how to cut off her access, how to determine amounts stolen, and how best to recover them, whether out her equity in the company or otherwise.
