Question: Bankruptcy - Illinois

I have no workers comp. I had a telemarketer covered under liability ins. She said she fell at work and sued me under wc. What do I do?

I initially won and the judge said she was an independent contractor. She appealed and she was declared my employee. My attorney didn't notify me of this until day 19 of a 20 day appeal. She wants $50,000. The Sub S Corp that she is suing owns nothing, but I do. Can the corp file bankruptcy? Can I sue my attorney for negligence? Can I make payments? Can I just retire? She didn't fall at work but said she did. My attorney says they doesn't know the answers to the above questions.  need a good corporate attorney and a good bankruptcy attorney. I can't afford 3 attorneys and have no workers comp. Help!!

The short answer to your question is that if the money owed falls under the category of "wages owed to an employee" you may not be able to get out of paying even if the corporation goes bankrupt.
