Question Details: I have rented a downstairs condo from a property manager that owns also the upstairs. I have complained about noise complaints almost since a two weeks after i moved in. He has talked to her that i hear stomping that is unbearable at times but nothing has be resolved. I have 3 months till my lease is up and the last time i complained he said it sounded like i want to leave and am frustrated. I don't want to leave but if i give up the lease he is giving my all these stipulations associated with me moving out before the lease is up. What are my rights and what should i do?
I am a lawyer in CT and practice in the area of the law. Tenants are entitled to quiet and peaceful possession of the leased premises. If the landlord permits a nuisance to continue on the premises that deprives the tenant of his/her quiet enjoyment, the tenant may leave without having to pa the balance of the lease under what is called constructive eviction. If the noise continues you may call the police and complain. this will place pressure on the landlord to do something more dramatic. You should try calling the police before moving out so you can later come to court when the landlord sues you for back rent and show the police report that was made as a result of the noise. you want to create a paper trail here.
