I have been cited for driving off without paying for gas, what can I do?

Question Details:

I bought gas with a bank debit card but did not get a receipt. Police officer called to tell me that charges were being brought against me for a drive off without paying. I checked my bank statement and there was not a deduction so I immediately called the manager of the gas station and apologized and gave him a debit card over the phone. Manager told me that everything was settled. Police officer called me several days later and told me a citation for $300 was being sent to me due to the manager of the store pressing charges. I am not guilty of this charge. What can I do?

Criminal Defense Law Answers

You could certainly fight the charge. You would provide evidence that it was an error which was promptly rectified as soon as you because aware of it--the fact that you paid over the phone once you were told of the issue would be strong evidence (bring documentation that the payment  went through). Criminal acts require criminal intent to be crimes; if you can show that you did not have the criminal intent, you should be able to defend yourself.
