Am I responsible for child support for my step-child after divorce?
Question Details:
MY WIFE HAS A CHILD FROM A PREVIOUS RELATIONSHIP. WE ARE PLANNING A DIVORCE.
Traditionally step parents are not obligated to support step children after a divorce, However, in New York, a party can be obligated to support a step-child in certain situations, specifically to prevent the stepchild from becoming a public charge under certain laws such as the N.Y. Family Court Act section 415 and the New York Social Services Law Section 101. So the answer is "no" if the child is not in danger of becoming a public charge.
