If I have a restraining order against me as part of my probation and a divorce agreement is granted giving me visitation rights, will the restraining order still be valid?
Question Details:
The restraining order states I can not have any contact with my soon to be ex-wife or her immediate family. This includes my daughter. If a divorce agreement is subsequently issued giving me visitation rights will the restraining order still be valid?
In Massachusetts, a custody or visitation order with regard to your children out of the probate and family court supercedes the restraining order. This is only for your children.
Make sure that any contact regarding the children is done as specifically stated by the family court order. If you contact your ex, or her other family members, you will be in violation of the restraining order.
