How do I get someone to comply with a court order to provide asset accountings of an estate?
Question Details:
I took my sister to court to provide my mothers trust and financial accountings. The judge signed a court order that she provides the info. She has only probated the trust with the court. What form do I have to fill out to request that the court make her comply with the rest?
Every state has a set of laws that provide a remedy to those that have a court order stating that someone is supposed to do "X" and does not do it. I am assuming that the Order was issued by the Probate Court in Michigan in the appropriate County. That court is governed by laws and procedures that will let you know what remedy the court can use to force your sister to comply. Sometimes it is an order of contempt (which can be a fine or another remedy); sometimes it may be removal as fiduciary. It all depends. Most states provide that you have to bring a motion before the court t ask for the relief you want (a motion is a formal request that is made to the court withthe required notice to the other party). You should speak with the clerk of the Probate Court about the situation an although they can not give you legal advice they can give you direction. It may also be time to hire an attorney yourself and see what your options are. Good luck.
