Question Details: I cannot reach my lawyer to verify his presence at my first court date tomorrow morning! I was charged w/DWI and pleaded not guilty to the magistrate since I had not drank that evening but had alcoholic drinks spilled on me earlier due to an altercation/fight. I took no tests at all, was respectful towards the officer and did not stumble or appear drunk on the car video. If I cannot reach my lawyer....should I: Represent myself and ask for an extension, ask for a court appointed attorney, plead w/the judge to dismiss due to lack of evidence (You can tell I have no legal expertise). Thks!
You have to be there and on time, of course, and until he doesn't show up, expect that he'll be there, even if you couldn't reach him. He may not be good at returning phone calls, but he has to be good at covering scheduled court appearances.
If not, you'll want to have a copy of your fee agreement or his letter of representation with you, just to be safe. When your case is called, you'll tell the judge that your lawyer isn't there, and you'll be able to show that you have, in fact, hired one, if he hasn't already notified them himself. You should not be forced to go ahead with the case without your lawyer in that setup.
