Debt collector still trying to collect on a settled debt

Question Details:

I had agreed to pay 3 payments in the amount of $187 and some cents in order to settle a debt with this creditor. I made the three payments using post-dated checks. The debt was settled in the summer of 2008. I saw a higher balance appear as a delinquent account on my credit report, so I called to inquire. The operator said I had made two $187 payments and 2 $88 payments and that the debt was never settled. I never authorized any $88 payments and I had received a letter confirming that the debt was paid. I cannot find the letter now. What can I do?

I hope you still have the bank statements from when those post-dated checks went through, ideally with the paid checks themselves or the images of the paid checks.  Otherwise, you'll want to get those checks (or copies) from your bank, and that usually takes a little time and money.  And keep your eyes out for that letter!

With the cancelled checks, you can write to the creditor, and to the credit reporting agencies, and insist that the item be taken off, with a warning that you will enforce your rights under the fair credit reporting laws if they don't.
