What do I need to do to get child support from out-of-state parent?
Question Details:
I had default divorce 4 years ago but child support was not determined. He just got married and had another child, but they live in New Mexico. I send his new address to child support enforcement because he still owes the government for my food stamp program. There no result from Child Support and Enforcement. What do I need to do to determine child support and get him to pay me?
You need to file an application for child support, in your county's court. Once you have that end of it done, your court will forward the matter to the county in New Mexico where he's living, and they will start a proceeding there to enforce your rights, under the reciprocal support enforcement statutes that all states have signed. He'll have to appear and provide proof of his income, and an order will be entered there; if he's working, the money should be taken directly from his pay and forwarded to you. You don't need a lawyer, and you probably won't even have to pay a filing fee.

Are you a lawyer?
