Rear-ended by uninsured driver

Question Details:

I had been hit by a uninsured driver that stated she was at fault and she would pay for the damages.  She stated this both in front of the police officer and other witnesses. I have been reaching out to her by phone and sent her a certified letter that included my vehicle estimates of over $7500 (with car rental) but she still has not contacted me. She claimed to just have sold her house for $210,000 so she stated that she had the money to pay for the damages. Unfortunately, when I called my insurance they stated that it had been cancelled because I had moved and they sent a statement that had gotten returned. What do I do now?

You might want to verify the date that your insurance was cancelled.  If your auto insurance was still in effect at the time of your accident, your uninsured motorist coverage may compensate you for your property damage and rental car expense since the amount you stated is less than the minimum requirement for uninsured motorist coverage in CA.

If the cancellation date of your insurance policy was on or before the date of the auto accident, you should sue the uninsured driver for negligence for the property damage to your vehicle and the rental car expense.
