Is attorney acting legally in my accident settlement?

Question Details:

I had a car accident and my lawyer received a check of $20,000 for the settelment; he said he only is going to gave me $2,000 because he needed to pay the doctor.

I am a CA lawyer.  This is really a tough one to answer because we do not know the amount of insurance available or whether or not you have uninsured motorist coverage, which can be used.  We do not know the extent of your injuries or the cost of your medical bills, and whether or not you have health insurance which paid for your treatment.  We do not know whether this case is admitted liability or disputed liability.  Your lawyer should provide you with a complete breakdown of all this information.

Ask for accounting. You are entitled to Total recovery mimus cost (attorney) minus attorney fees minus known liens from service providers (doctors, chiropractor, etc). Do you know how much your medical bills are? Your settlement should have been done sooner to keep medical bills low or you recieved less settlment --not consistent with your injury.
