What are my options to get severance package and unemployment benefit?
Question Details:
They said they decided to eliminate my position to cut the company's costs. The HR manager said it's not because of me, my performance or whatsoever. I was told that it is the last day and my insurance will be terminated at the end of this week. I was too shocked to remember everything that she said but I think she said I will be paid for the paid vacation left in this year, and bonus. I was not asked to sign on any agreements. I was an at-will employee. Am I getting what I am supposed to get? What are the options I have to get a severance package and unemployment benefits?
You won't get a severance package, you are not required to be given one since you are an at-will employee. Basically an at-will employee is one who can be fired with or without cause. The issue in your situation is she cannot simply terminate your insurance at the end of the week, she has to give you the option of COBRA. Contact your insurance company immediately and your former employer and the state's department of labor.
Further, you better ensure you receive not only unused vacation pay and bonuses but see if you can receive any part of your unused sick leave.
