I got in a car accident; we were rear-ended and I went to the doctor. He told me that I had muscle tears but he didn't take any W-rays, he just sent me home. He didn't even check out my back and my back pain has worsened.

Go to another doctor and get the treatment you need based on your medical condition.
You should consult another doctor, who will take x-rays and will provide physical therapy. When you complete your treatment and are released by the doctor, the medical reports will document the nature and extent of your injury and those medical reports along with the medical bills and other factors such as wage loss will be determinative of the amount of compensation you receive.
