What to do if I got a summons to go to court regarding a debt?
Question Details: I moved before I got the notice and have no way to get there. No car and its an hour and a half drive. I tried calling the lawyer for the creditor and he hasn't called me back If I don't show up will I get arrested?
If you don't show up on the court date, you will default. This actually means you will loose without even making your argument as to why you may not owe the debt. The court can continue the case; however, both parties must agree. I understand that the lawyer is not calling you back. There are attorneys who practice near the court where your trial date is and may take your case, file an appearance for you, and represent you in court. This will eliminate the default issue.
