If I got an out-of-state DUI, can I transfer my sentence to my home state?
Question Details:
I got a DUI in PA last 07/09, but I was on vacation from my permanent residence in FL. I have been offered the minimum sentence for a 2nd DUI. This was my 2nd DUI within 5 years in PA, as I used to live there. I am appearing for my sentencing at the end of this month and I was wondering if, and how, to get my sentence (90 days work release) transferred to FL so I can continue working my job as part of my work release, rather than spending 3 months in PA.
There are some instances where you can transfer probation and sentencing but I would suggest that you see help from an attorney in your area before the end of the month on this. You need to make sure that you have all the connections with Florida established before you go before the Judge to make it easier for the DA to consent and for the Judge to agree. They are not going to just allow you to go without knowing that there is someone and something in place to monitor you for your sentence. And Florida knows about it all now if they and PA are part of the interstate pact that share information. Get hlep with it all. And good luck.
