Question Details: I was thinking about refinancing with a certain mortgage co. and gave my credit card number to them for an application fee and then I changed my mind. The mortgage company still charged my credit card $750 even after telling them in an email not to charge my credit card and that I changed my mind and had decided not to refinance with them. I told them in an email this before they charged my card. I never signed anything. After contacting the mortgage co. they told me that they would credit me $350 leaving me $400 short. What are my rights? I want all of my $750 back. Can they legally do this?
I am a lawyer in CT and practice in this area of the law. if you signed/agreed to permit the company to charge your card, but called it back before the charge and then they charged it anyway, you have a valid claim. If the company refuses to refund all your money, then i suggest that you file a small claims complaint against the company to obtain your money. hopefully the company will give your back upon the filing of the complaint. the nature of your claim is unjust enrichment.
