I filed bankruptcy and surrendered a vehicle but the lienholder hasn't repossessed it yet, can I charge for storage?
Question Details:
I filed Chapter 7 and surrendered a classic Mustang in the process. I have not heard from the original lienholder (a credit union in NE) regarding repossession of the vehicle. Can I charge a storage fee for the fact that I'm keeping it in doors and safe? What options or leverage do I have with the lienholder? They are more than 500 miles away from me and the car.
You surrender it by delivering it. If the lender has to come and get it, there's probably an extra charge you will incur for that. If you deliver it, it is not "repossessed," but rather surrendered, which looks better in the future on credit ratings.
