Question Details:

I fell off a curb in a strip mall where the curb was very high, twisted my ankle and still have pain & swelling 4-5 months later. I have no health insurance and therefore sought no medical attention at the time of the fall. I believe that the curb height does not conform to the curb throughout the entire mall/ shopping center. Two people witnessed my fall and to my knowledge, at least one of them is willing to speak up on my behalf.

Personal Injury Law Answers

I am a lawyer in CT and practice in this area of the law.  I suggest that you go see a local personal injury lawyer to determine whether the mall is at fault.  If the curb is too high and it was reasonably foreseeable that someone would get hurt, then you may have a valid negligence claim.  I am not sure how much damages you have, but it may be worth pursuing and settling out of court.
