I was uninsured and caused an accident 1 1/2 years ago, now the other person's insurer is suing me; what can I do?

Question Details:

I caused an accident 1 1/2 years ago. My insurance had expired. The other person's insurance paid for their expenses. Now I received a letter from the court that a complaint was filed and they want me to pay $52,000. I am a recovering **** addict, working about 13 hours a week. I entered a long term rehab after the accident, on my own, and I am trying to go to school. I am 27. I am trying to learn a trade. I have no assets and can barely pay rent. Sometimes my parents will help me there. What should I do? I need to help myself before I can do anything.

The insurance company is permitted to sue you for the money it had to pay out to their insured.  your lack of insurance is a problem because the insurance company has a rather large judgment against you.  your solution is fairly limited to filing for bankruptcy.  filing bankrupcty will discharge this debt completely and you will never have to repay any portion of the debt as a result of banruptcy filing.  the problem you face is that the insurance company can get a judgment against you for the 52K and garnish the wages that you get at work thereby making your life more difficult.  i suggest going tot he bankruptcy court in your state and asking for a pro bono lawyer that can help you file the BK petition and dischage this as well as any other debts you have.
