I can't afford a criminal lawyer but I make too much for a public defender. Are there any other options?

Question Details:

My ex-employer terminated me because they accused me of theft. I was charged, arrested, and let go a couple of hours later (without having to post bail). I never stole anything from them and I have a clean background. I finally received unemployment after 3 months. The unemployment department said there was lack of evidence for my former employer to prove its claim. I also have been approached by the DA; they want me to accept a plea deal. I don't know what to do; I can't afford a lawyer, but make too much for a private attorney.

Unfortunately, you are obviously in a very difficult position.  In order to qualify for the services of a public defender, most states require you to sign a financial affidavit that demonstrates that you are indigent.  You have stated that you make too much to be eligible for a public defender, but you have also stated that you are currently unemployed.  You may wish to bring this to the court's attention.  In any event, if you cannot obtain a public defender, you need to treat hiring an attorney as if you were hiring a surgeon for a "life or death" surgery.  Ask family and/or friends for a loan, or take a loan out on a credit card -- your liberty is at stake, and you need to do whatever it takes to secure legal counsel.  Good luck.

See if you qualify for Legal Aid or see if they can recommend someone to help you.  Also, check if there is a law school nearby to where you live; they typically run free/low cost clinics that handle these type cases.  Additionally, contact the local Bar Association in your county; they may have a list of attorneys who will take your case "pro bono" (for free) or at least for a reduced fee based on your income/circumstances.
