Can I sue if I ate a granola bar and it had worms in it?
Question Details:
I bought a peanut butter granola bar and I ate most of it. When I got towards the end of it I notice there were 2 worms in it and what looked like a nest in the bar. The bar was in date and I wanted to know if I can file a lawsuit against them for this. This bar was my favorite and I bought them all the time because I would eat a couple a day. I called the company to complain about it and tell them. All they did was send me some coupons and I do not think that is good enough for what this has done. I will no longer buy any granola bars because of this and I crave them all of the time.
Clearly the granola bars is not supposed to have worms inside. This type of claim is for negligence and/or products liability. Do you have the worms in the wrapper still? did you take any pictures to document the worms as evidence of your claim? If you did, you can certainly file a lawsuit against this company and the company is sure to settle to avoid the bad press they will get and the heat from the health department in their factory. If you do not have any evidence other than you word, then you will have a difficult case as a result of a lack of evidence. while you may testify to the worms your word will be the only thing you have. I suggest hiring a lawyer to write a letter to the company to see if he can settle this for some more money. The company may settle to avoid the expense of a trial.

Are you a lawyer?
