I bought a car from a guy who forged the title and have now discovered the car has frame damage, who do I sue?

Question Details:

I bought a used car from a gentleman. The car was bought from salvage lot by an auto dealer. The name on the title was state farm as owner. The gentleman that sold it to me signed the name of the owner of the dealership that bought car from salvage lot on my bill of sale. He forged the signature. I spoke with the dealer and he said that title should of been in the name of the party that sold it to me and that guy just works with him. There is frame damage and a total loss on vehicle that wasn't disclosed to me. What are my legal rights in this situation?

You could file a lawsuit for fraud against the seller of the vehicle.  The fraud claim would be based on the forged signature and the failure to disclose the damaged frame which effectively rendered the vehicle worthless.  Although the dealer is correct, that the name of the seller of the vehicle should have appeared on the title, since the individual who sold you the vehicle works for the dealer, if the dealer had knowledge of the damaged frame and/or forged signature, the dealer could be named as a defendant in your lawsuit for fraud.  Prior to including the dealer in a lawsuit, further investigation is warranted to determine what role if any the dealer had in this matter.
