Question Details: My husband spent 20 years working for the Western Co. loading chemicals in the bulk plant. He died recently with a Pancoast tumor. The hospice nurse told us that it wasn't normal smoker's lung cancer because that starts at the bottom of the lung and goes up. I believe it is from all the chemicals he inhaled on his job and I don't believe the company provided enough safety features to protect the employees from lung damages.
I am a lawyer in CT and practice in this area of the law. You need to have a doctor do an examine that will determine the exact cause or likely cause of the death. If the doctor can link it to the chemicals at work, this is a step in a positive direction. Then you would need to show that the employer knew or should have known that the chemicals were dangerous and didnt do anything to inform its employees and failed to take precautions. I would also hire a lawyer to help here.
