Do you have an attorney?  If so, your attorney should answer.  I don't know what type of claim you have.  If there is a wrongful death claim, the executor of your spouse's estate would bring the action for the benefit of the statutory beneficiaries, of which you are one.  If you someone have a claim on your own, you keep the money.  I can't answer your question, without more info.
