Do I need to attend a hearing for the discovery of assets, if I don't have any assets?
Question Details:
I owe an ex-landlord $7000. I haven't been paying on it, as I don't have any assets or cash. They sent me a Citation to Discover Assets. However, I don't have any assets and I don't have any way to pay except for small payments. Should I call the lawyer and tell them that, in hopes that he'll accept a payment plan?
You must go to the citation hearing, unless you want a rule to show cause (and later, a bench warrant issued for your arrest). You should certainly go and explain your situation to the creditor's attorney (with proof, of course). If you don't have the means to pay, the creditor's attorney may accept small payments, but they don't have to. If you work, they could seek to garnish your wages, as well.
