Question Details: The charge was dismissed with defendant stipulates to probable cause of arrest. Now my reputed employer is going to file for a H1B visa. Is this arrest going to create a problem with my visa process? In 2 months my arrest record will be expunged, do I still have to declare the arrest in the H1B petition? If I declare it my employer might fire me?
In all likelihood the arrest for your alcohol intoxication will have no bearing in an adverse way as to your current visa state since ordinarily one does not get deported for a misdemeanor unless such is a crime of moral turpitude. Being intoxicated in public is not a crime of moral turpitude warranting deportation.
