What to do if I'm late on my rent but have paid a small portion of about 20%?
Question Details: My landlord hasnt served my a notice at all. She states that she will physically move me out this weekend and start showing the place to potential renters. Is this legal? I explained she would have the money Friday when I get paid and she said that's not good enough. Im nervous becaus earlier this month she entered the house with no warning. She let herself in to demand payment. What are my rights and can she do this?
If a tenant fails to pay rent, the landlord DOES NOT have a right to "physically move" a tenant or his belongings out. There is a process that the landlord has to follow if the tenant does not pay the rent. Also, your landlord did not have a right to enter your premises without your permission and especially without your presence (as a tenant, you do have a right to what is know as "quiet enjoyment" of the leased premises, which inlcudes having privacy).
