I am being sued, which insurance company cover me?
Question Details: In 2006, I got sued for an accident I caused. My insurance at that time settled in court. I have since switched insurance company. Now I'm being sued again but by their daughter. Which insurance company now covers me? The old one or the new one?
The insurance policy in affect at the time of the accident should provide coverage. I would send the complaint to both companies to be on the safe side. If the daughter was under 18 at the time of the accident, the 2 years to file a complaint would be tolled until the minor reaches 18. At least in California that is the case.
Generally, the new one would now cover you. But you may have some issues that a lawyer will have to review regarding the prior settlement. An important one is: does the prior settlement prohibit the daughter from suing you? Not knowing the specifics of the case, the age of the daughter, or the settlement terms, I am only alerting you to the fact that the terms of the prior settlement must be reviewed.
