I am a witness/victim of domestic violence who now has a bench warrant for FTA

Question Details:

I am the victim in a domestic violence case and a bench warrant has been issued against me for not appearing. However Idid not receive a subpoena. Can I avoid jailtime, and will the warrant be dismissed if they drop the charges against my fiance?

Criminal Defense Law Answers

It's possible but by no means at all certain that the warrant would be dropped if the charges were dismissed.  It's more likely that the charges aren't going to be dropped until you go to court and explain why you didn't appear.  I think it's unlikely that you'd be sent to jail for this (aside from being held after you were arrested on the warrant, until you could post bail or be taken before a judge), it's usually a fine and court costs.

Please get some counseling before dropping the domestic violence case.
