I am a P.R. for an estate. My attorney and I have a fee dispute. Can I just list an attorney fee amount that I am willing to pay on a verified statement and advise that an objection may be filed. Then also on the statement, request the judge to approve the document on the date set allowing enough time for me to send notices and any objections being filed. I am hopeful that the attorney will not object after they see the amount paid out to administrations costs verses what is remaining for the widow. Which is less than $0.00.
You could probably make this work. Your papers would have to make clear, that you were asking the court to decide the fee dispute between the estate and the attorney, and that you were giving the attorney notice of that request. The court definitely has the power to decide the issue, and relationship between the estate, the net to the widow, and the amount spent and being sought for expenses, will certainly be taken into account.
