I am 54 , what can I do to protect myself from getting fired?
Question Details:
I am 54 and have a good corporate job as a global commodity manager of plastic purchasing. I have had run-ins with my boss and approached his boss regrading negative comments onmy performance. I worry about getting fired. What can I do legally not to get fired? Can they fire me? What can I do to avoid firing and why would they not fire me?
There is very little you can do, unless you have a contract: absent an employment contract or impermissible discrimination (see below), companies may fire employees at will, at any time, for any any reason.
Because you are over 40, you are in a protected category. Companies may not discriminate against employees over 40 on account of their age. However, while that means you may not be fired becausue you are 54, it does *not* mean they can't fire you. You may be fired for any non-age related reason, including simply that your boss doesn't like you.

Are you a lawyer?
