I'm 17 and have untreated medical issues which my dad refuses to help me with, can I sue my him?
Question Details:
My tonsils have needed removal for two years or more. My bottom wisdom teeth have needed removal for about 2years. I have undiagnosed ashma, that of which has been caused by the second-hand smoke from my Dad. These three medical conditions are affecting my overall health. I have made my Dad aware multiple times and he still hasn't taken me to a doctor to treat these. It's not like he wasn't able to afford it, my Mom recently passed, he got social security money; with that money he bought a motor home, a car, paid the mortgage, and got a duplex built. Do I have a claim?
You dad has a responsibility to care for you and make sure you receive necessary medical treatment as he is your legal guardian. You dad likely has insurance if he is employed and if he is not, he likely has some kind of health plan where you probably named as to receive health benefits. If your dad is not taking care of you properly, Department of Child Services may be called and they can take you out of the home and place with with a foster family who will care for you unless other family members would take you - I am certain your dad does not want that. You should tell him that this is an emergency and that you need to see a doctor asap. If he does not listen, then you need to call a relative to help you as they may be able to take you to a dentist and have the dentist send the bill to your dad. I would go to the doctor and have them send the bill to your dad- while he may be mad, you have no choice. You cannot however, file a lawsuit against your dad. Rather, this is something the police deal with where parents neglect their kids.
