Husband lightly backed into a work van on work property in his own personal vehicle. Is he liable for repairs to work vehicle?

Question Details:

My husband was backing out of a parking space at his work there were no other cars. He was at a slow roll when a work van came into his sight he stopped but the work van has damages. This happened on work property. He was in his own personal vehicle. Is he liable to pay for damages if the other driver failed to stop and my husband's vehicle has no damage?

Your husband is liable, if he was negligent, which is legal carelessness.  Ordinarily, it has to be proved;  the fact that it was at work, and that the other vehicle was owned by the employer, has nothing to do with that at all.

Most of the time, a driver backing out of a parking space has the legal responsibility to do that safely, yielding the right of way to anyone who isn't also coming out of a parking space.  However, it's possible that this might be an accident without negligence, for example if there was a van or SUV blocking vision, and there was nothing at all that your husband could have done differently to prevent this.
