How to enforce a verbal agreement?
Question Details:
Five years ago my son-in-law moved our double wide to NC from VA. He and I made a verbal agreement that he would make the monthly payments. Less than 2.5 yrs ago he came to me and my husband telling us that he could not afford to make the complete payment, so we told him we would cut the payment in half. He made a total of 5 payments after that. 2 weeks ago he just up and left my daughter and children. My daughter has not been able to work for 11 yrs. Is there anyway that I can get the back payments? And how do I do this?
I am a lawyer in CT and practice in this area of the law. An oral contract is generally enforceable where there is a meeting of the minds. You may certainly file a claim for breach of contract based on his promise to make payments to you as well as the fact that he made some payments. The issue that you will have is locating your son-in-law and collecting the money. if he is no longer in this state and you do not have an address from him, you cannot properly serve him. I suggest trying to locate him and then speak to a lawyer about filing a lawsuit.
