Question: Divorce, Marriage, Alimony - New Jersey

Asked on 11/4/2009

How much weight do county judges have?

My son's father was never around because he didn't want to be a father. Suddenly he shows up years later taking me to court blaming his absence on me? The judge gave him visitation the next day without concern for my sons welfare. My son's fatherdenied threatening to kill me and my son to the judge believed him. But he did, however, admit it to the mediator that the judge sent us to. Is this legal?

I  am a lawyer in CT and practice in this area of the law.  Family court judges try to do what is fair and equitable and in the best interests of the child.  In this case, you need to present evidence to the judge - i.e. testimony from the mediator - that your son's father is an unfit parent and will expose him to harm.  You should hire a lawyer if you can afford it to come to court for the day to help you at a hearing as to whether the father may visit your son due to his conduct.
