Although I do not practice law in the State of West Virginia, here are my initial impressions.  The general rule is that the amount of time (if any) that a person will do for a crime depends on a myriad of factors, including but not limited to:  whether the charge is resolved via plea or after trial, the individual's prior criminal history and whether or not he is currently on probation or parole, the degree of the offense charged, the wishes of the victim, and the particular sentencing judge.  Thus, it is impossible to predict how much, if any, time you will do at this point in time.  In any event, it is clear that you need to hire a criminal defense attorney to advise you on this, and other issues related to your charges.  Good luck.
