Question Details: I was in a car accident where a lady rear ended me. I was taken to the hospital but was not injured. My husband was in Iraq at the time and could not come home. I tried to get financed for another vehicle but was unable to do so. I ended up having to take my daughter out of Pre-K because I have no transportation. I had to put all of our belongings into storage. Then move back to my home state to have help from my family. I don't want to bet a layer but I am unsure of how much to ask for as a settlement for the pain and suffering for my daughter and I.
I'm so sorry for all your trouble, but if you were not injured in the accident, you cannot collect anything for pain and suffering. There must be a physical injury in order to make a claim for non-economic damages of pain and suffering. Regarding your car, however, you should be able to collect for the property damage to the vehicle. If the at-fault driver was injured, make a claim for property damage with their insurance company. If no insurance is available, you'll need to sue them.
