How long will the eviction process take after I receive a notice to quit?
Question Details:
If you remain on the premises after the time given to vacate in the notice, then your landlord will have to file an "unlawful deatiner" action in court; this is an eviction lawsuit. However, it can take several weeks to go to trial. Once it does, assuming that the court isues a "writ of possession" to your landlord, they will then have the right to take back the premises. If you still remain on the property, your landlord can have a sheriff physically remove you if ncessary; that will take another week or so. Therefore, in answer to your question, you most probably have anywhere from 3-6 weeks or more before you have to leave.
