How long does it have to be before you can file for abandonment when a spouse leaves home?

Under the North Carolina statute, your divorce complaint would have to state that the facts that are your grounds for divorce (and abandonment is specifically included in the law, as valid grounds) have existed for six months, so that's your waiting period.  That requirement doesn't apply if you go for a "no fault" divorce based on one year's separation.  Section 50-8 of the General Statutes has the details.
