How long before the state considers a contractor to have abandoned a job on your property?
Question Details: If he has abandoned me, how long do I have until all his equipment is considered to be mine?
Florida Statute 489.129 presumes that a contractor has abandoned the project if no work has been complated for 90 consecutive days without "just cause." That is of course a term of art. However, depending on your circumstances, you can show abandonment if the contractor clearly refused to recomence work, or if other factual circumstances make it clear that the contractor is not performing. Each case is different, and experienced construction law counsel will be better able to advise you after he or she has reviewed all of the facts of your situation.
