How long after an accident can you be sued for bodily injury in Maryland?
Question Details: In 2007 someone hit my car and the accident was deemed their fault. Now they have an attorney and are suing me for $30,000 for bodily injury and pain & suffering.
I am a Maryland barred attorney - the general statute of limitations is three years in this state.
I am a lawyer in CT and practice in this area of the law. In most states, you have 2 and sometimes 3 years to bring a personal injury accident or negligence case. Given the time period that you are talking about here it may be close. If you are being sue, I suggest sending the complaint to your insurance carrier so that it can defend you. The sooner you place the carrier on notice the better so that it does not turn around and deny coverage on your failure to notify it timely. I also suggest filing a counterlcaim for the damages to your car.
