How I can sue my previous attorney?
Question Details:
I made a call to my previous chiropractor to get an adjustment and they happened to mention to me that my attorney did not pay them. I have the proof with check stubs for chiropractor, the attorney, and for myself. After almost 3 years I am still going through pain and suffering. Is there anyway that I can re-open the case and sue when the total amount was $8500 minus med bills and my paperwork says that I should have had $4950 but only got $3500. I am trying to figure out where my other $1400 went. And I was told (my attorney) at the time also did not pay on several other cases.
You need to immediately contact the Texas State Bar and file a bar complaint against your attorney. You can sue your attorney but oftentimes the statute of limitations is a consideration and depending on the exact scenarios in your situation, your time may have run in civil court. This should not prevent you from pursuing the matter via the state's bar, because it will create an investigation into this matter and many states do have funds to help offset these losses by the consumer and/or help in orders to force the attorney to pay you.
