How do you undo a life estate?
Question Details:
My mom found out recently that her husband gave her a life estate in the primary residence they live in now. She found this out because she receive a tax bill in her name and was shocked because it was in her name and because she couldn't pay it. Her husband had bought and had title to the home. Her husband paid the tax bill but she does not want a life estate in their home. How does she take the life estate off?
There must have been something else here that you forgot to mention. Just because the tax bill is in her name does not by itself indicate a Life Estate. In any event, a person cannot deed property of any kind and in any manner to someone unless the agree. The law says that they must "accept" the property, but the law is vague as to exactly what "acceptance" amounts to. I would suggest that she notify her husband that she does not "accept" and that she does not want a Life Estate and for him to see a lawyer and correct this.
