Question: Divorce, Marriage, Alimony - Washington

Asked on 8/25/2009
How do I protect myself from being legally responsible for my Husband's debts?
I recently filed for a legal separation. After the paperwork was filed I found out that my financially irresponsible husband opened another credit card between the time he moved out and the paperwork was filed. This credit card does not appear in the documents filed. Our court date has been set, but not yet come. What steps do I need to take to make sure I am not held accountable if he defaults?

This will be easy for you to handle.  When you get ready to finalize your divorce, you'll need to prepare two court documents.  First is the Decree of Dissolution, and the second is the Findings and Conclusions.

On the Decree, there is a space for "husband's liabilities" - it's around Paragraph 3.10 or thereabouts.  Check the box that says "Husband shall remain responsible for all dates incurred by him since the date of separation which is _________________(DATE)           .  I would also include this language "including but not limited to LIST NAMES OF CREDIT CARDS HERE".

THAT WILL COVER YOU.  Good luck.
