How do I get myself appointed as executor over my wife's estate?

Question Details:

My wife just passed away and they froze our bank account. This is the only thing that was in both our names. Everything else was in my name. So how do I become her executor so I can get my bill money out of the bank? My paycheck is direct deposited into it.

I am so sorry for your loss.  First you should stop the direct deposit as soon as you can because you are going to need an order from the court to have the funds released. You need togoto the probate court in the county in which your wife resided at the time of her death and file a petition to be appointed as the personal representative of her estate.  If she died with out a Will it is known asan administration in some states.  A court may issue temporary letters to you to allow you just to access the funds.  Good luck.
